在1934年的美国参议院选举中，彭德格斯特指定杜鲁门竞逐密苏里州的参议院席位，并支持总统罗斯福的“新政”。可是在民主党内部的提名选举中，杜鲁门却一度遭遇了竞争对手塔克·米利根（Tuck Milligan）的强烈反对。而塔克的兄长莫里斯·M·米利根在日后除了打倒彭德格斯特的政治集团外，更在1940年的参议院选举与杜鲁门对垒。参议院选举期间，尽管堪萨斯城有3人被杀，但选举没有被打断。最后在“彭德格斯特的参议员”的阴霾笼罩下，杜鲁门成功当选。任职参议员初期，他在彭德格斯特影响下大力支持“新政”，但杜鲁门本人说支持“新政”完全是自己的个人意愿。
米利根在1936年对劳埃德·C·斯塔克当选密苏里州州长一事展开了调查，结果有258人被定罪。但更重要的是，米利根发现彭德格斯特从1927年至1937年间，都没有缴交联邦税款，而且又暗中诈骗保险。斯塔克在竞选州长期间曾得到彭德格斯特的祝福，可是他在后来的审讯中却出卖和指证了彭德格斯特，并从彭德格斯特和杜鲁门手上，接管联邦政府发到地方用作推行“新政”的资金。最终在1939年，彭德格斯特承认控罪，除了遭罚款10,000美元外，还被判入狱15个月。该次对彭德格斯特的审讯，曾因他的身体状况恶化又心脏病病发，而多次拖延。
